2. Scope of Services
Mold Testing Houston LLC provides on-site mold inspection and testing services performed by licensed professionals.
Our role is limited to visual inspection, collecting and analyzing samples for the presence of mold spores and providing written reports based on laboratory results.
We do not perform remediation, removal, or cleaning services. The client is responsible for taking corrective actions based on the findings in the report.
3. Licensing and Accreditation
All inspections are conducted by licensed mold assessment consultants or technicians in accordance with TDLR (Texas Department of Licensing and Regulation) standards.
All laboratory analyses are performed by accredited laboratories, and all inspection reports are reviewed and signed by a licensed professional under TDLR requirements.
4. Payments
Payments are due upon completion of work to a representative of Mold Testing Houston LLC, unless alternative arrangements have been made in writing.
Accepted payment methods:
- Online Payment via our invoicing system
- Zelle transfer to moldtestinghouston@gmail.com
- By Phone with Credit Card
- ACH bank transfer
Any balance not paid within 15 days of the due date will be considered delinquent and may be sent to collections or subject to a lien.
Delinquent accounts will incur a 1.5% monthly late fee (18% annual).
Returned checks (if accepted) are subject to a $35 return fee.
A collections fee of 33% will be added to all unpaid accounts referred to collections.
A lien filing fee of $348 may apply where applicable.
Failure to remit payment in accordance with these terms will result in forfeiture of all discounts, coupons, and/or credits previously applied.
5. Taxes
All quoted prices exclude applicable federal, state, or local taxes unless expressly stated otherwise.
Applicable taxes will be added to the total invoice unless the Client provides valid tax-exempt documentation.
6. Cancellations
If a Client cancels after signing an estimate, invoice, or contract, but before any on-site work is performed, any deposit or down payment is non-refundable.
Once an inspection has been performed or a technician has arrived on-site, no refunds will be issued.
7. Service Modifications
Mold Testing Houston LLC reserves the right to:
- Modify, update, or run promotions on any service at any time
- Change service prices without prior notice
If a price decreases after the date of purchase, no refund or price adjustment will be provided.
8. Limitation of Liability
Mold Testing Houston LLC shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profit, property damage, or personal inconvenience resulting from any service, report, or advice provided.
We make no warranty, expressed or implied, regarding the future condition of a property or the absence of mold after testing.
Our reports are based solely on the conditions observed and samples collected at the time of inspection.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence or any liability that cannot legally be excluded under applicable law.
9. Client Responsibilities
The Client agrees to:
- Provide safe access to all testing areas.
- Pay all fees as outlined in this Agreement.
Failure to provide proper access or preparation may result in rescheduling fees or incomplete results.
10. Reports and Results
Inspection reports are based on visual findings and samples collected during the visit.
While our laboratories and inspectors follow strict protocols, no guarantee is made that mold will not exist in other areas not sampled.
Reports are for the exclusive use of the Client and may not be shared, resold, or altered without written consent from Mold Testing Houston LLC.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas.
Any disputes arising under these Terms shall be resolved in the appropriate courts located in Dallas County, Texas.
12. Text Messaging (SMS) Terms
These Text Messaging Terms govern the SMS program operated under the Mold Testing Houston brand by Mold Testing Houston LLC. By providing your mobile number and checking the SMS consent box on our contact form, you agree to these terms.
Program description: When you opt in, we may send text messages about your inspection request, appointment scheduling, reminders, updates, and follow-up communication.
Opt-in and consent: You opt in by checking the consent box and submitting your mobile number through our website. Consent is given voluntarily and is not a condition of purchasing any goods or services.
Message frequency: Message frequency may vary based on your interaction with us.
Message and data rates: Message and data rates may apply. These charges are billed by your mobile carrier, and we are not responsible for carrier charges you incur.
Opting out: Reply STOP to opt out. You can cancel SMS messages at any time by replying STOP to any message from us. We will send one confirmation message, after which you will receive no further texts. To opt back in, sign up again through our contact form.
Help: Reply HELP for help. For assistance, reply HELP to any message or call us at 832-409-2125.
Carriers: Carriers are not liable for delayed or undelivered messages. Delivery depends on your wireless provider and is outside our control.
Privacy: We will not sell, rent, or share your mobile number or your SMS opt-in consent with third parties or affiliates for their marketing purposes. Mobile information collected for SMS is used only to deliver the messages described above and is shared only with service providers who help us operate the messaging program. Updates: We may update these Text Messaging Terms from time to time. Continued participation after we post changes means you accept the updated terms.
